NetworkTik Privacy Policy

PLEASE READ CAREFULLY BEFORE ACCESSING NETWORKTIK.COM. This Privacy Policy explains the practices of NetworkTik, including your choices, regarding the collection, use, and disclosure of certain information, including your personal information in connection with the NetworkTik service (the “Service”).

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use Agreement.

1. DEFINITIONS

Usage Data. Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

• details of your interactions with our customer service, such as the date, time and reason for contacting us, and transcripts of any email conversations;
• device IDs or other unique identifiers, including for your network devices;
• device and software characteristics (such as type and configuration), statistics on page views, referring source (for example, referral URLs), IP address (which may tell us your general location), browser and standard web server log information.

Information collected via the use of cookies (“Tracking Cookies Data”): We collect information from the use of cookies, web beacons and other technologies, including ad data (such as information on the availability and delivery of ads, the site URL, as well as the date and time). Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service. • Session Cookies. We use Session Cookies to operate our Service.

Testimonials: We may post customer testimonials on our website, which may contain personally identifiable information. We do obtain the customer’s consent to post their name and/or photo along with their testimonial via email prior to posting the testimonial on our website. However, if you wish to request the removal of your testimonial, please contact us.

Information from other sources: We also obtain information from other sources. We protect this information according to the practices described in this Privacy Policy, plus any additional restrictions imposed by the source of the data. These sources vary over time, but could include:
• service providers that help us determine a location based on your IP address in order to customize our service and for other uses consistent with this Privacy Policy;
• security service providers who provide us with information to secure our systems, prevent fraud and help us protect the security of NetworkTik accounts;
• payment service providers who provide us with payment or balance information, or updates to that information, based on their relationship with you;
• online and offline data providers, from which we obtain aggregated demographic, interest based and online advertising related data.

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

We use information to provide, analyze, administer, enhance and personalize our services and marketing efforts, to manage member referrals, to process your registration, your orders and your payments, and to communicate with you on these and other topics. For example, we use such information to:

• prevent, detect and investigate potentially prohibited or illegal activities, including infractions and breaches of our Terms of Use, and to enforce our Terms of Use (such as determining whether and for which NetworkTik signup offers you are eligible and determining whether a particular device is permitted to use the account consistent with our Terms of Use);
• analyze and understand our audience, and improve our service (including our user interface experiences and service performance);
• communicate with you concerning our service so that we can send you news about NetworkTik, details about new features and content available on NetworkTik, special offers, promotional announcements, consumer surveys, and to assist you with operational requests such as password reset requests. These communications may be by various methods, such as email or online messaging channels.

4. TRANSFER OF INFORMATION

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

NetworkTik will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

5. DISCLOSURE OF INFORMATION

We disclose your information for certain purposes and to third parties, as described below:

Service Providers: We use other companies, agents or contractors (“Service Providers”) to perform services on our behalf or to assist us with the provision of services to you. For example, we engage Service Providers to provide marketing, advertising, communications, security, infrastructure and IT services, to customize, personalize and optimize our service, to provide bank account or balance information, to process credit card transactions or other payment methods, to provide customer service, to analyze and enhance data (including data about users’ interactions with our service), and to process and administer consumer surveys. In the course of providing such services, these Service Providers may have access to your personal or other information. We do not authorize them to use or disclose your personal information except in connection with providing their services (which includes maintaining and improving their services).

Analytics: We may use third-party Service Providers to monitor and analyze the use of our Service, such as:
• Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

• Hotjar. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device’s IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Remarketing Services: We use remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Service. Examples of service providers for this purpose may include:

Payments: We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. Protection of NetworkTik and others: NetworkTik and its Service Providers may disclose and otherwise use your personal and other information where we or they reasonably believe such disclosure is needed to (a) satisfy any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms of use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address illegal or suspected illegal activities (including payment fraud), security or technical issues, or (d) protect against harm to the rights, property or safety of NetworkTik, its users or the public, as required or permitted by law.

Business transfers: In connection with any reorganization, restructuring, merger or sale, or other transfer of assets, we will transfer information, including personal information, provided that the receiving party agrees to respect your personal information in a manner that is consistent with our Privacy Policy.

Law enforcement: Under certain circumstances, NetworkTik may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements: NetworkTik may disclose your Personal Data in the good faith belief that such action is necessary to:

• To protect and defend the rights or property of NetworkTik
• To prevent or investigate possible wrongdoing in connection with the Service
• To protect the personal safety of users of the Service or the public

6. YOUR CHOICES

Email Communication: If you no longer want to receive certain communications from us via email, simply click the “unsubscribe” link in the email. Please note that you cannot unsubscribe from service-related correspondence from us, such as messages relating to your account transactions.

Interest-Based Ads: Interest-based ads are online ads that are tailored to your likely interests based on your use of various apps and websites across the Internet. If you are using a browser, then cookies and web beacons can be used to collect information to help determine your likely interests. If you are using a mobile device, tablet, or other device that includes a resettable device identifier, then that identifier can be used to help determine your likely interests.

7. YOUR RIGHTS

You can request access to your personal information or correct / update out-of-date or inaccurate personal information we hold about you. You may also request that we delete certain personal information that we hold about you.

When you visit the “My Account” portion of our website, you have the ability to access and update a broad range of information about your account, including your contact information, your NetworkTik payment information, and various related information about your account. You must be signed in to access the “My Account” page.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may reject requests that are unreasonable or not required by law, including those that would be extremely impractical, could require disproportionate technical effort, or could expose us to operational risks such as trial period fraud or abuse. We may retain information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes and to fulfill the purposes described in this Privacy Policy. We take reasonable measures to destroy or de-identify personal information in a secure manner when it is no longer required.

8. SECURITY

We use reasonable administrative, logical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the absolute security of your personal information.

9. “DO NOT TRACK” SIGNALS

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

10. OTHER WEBSITES, PLATFORMS AND APPLICATIONS

The NetworkTik service may be provided through and/or utilize features operated by third party platforms or contain links to sites operated by third parties whose policies regarding the handling of information may differ from ours. These websites and platforms have separate and independent privacy or data policies, privacy policies, notices and terms of use, which we recommend you read carefully. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

11. CHILDREN’S PRIVACY

You must be at least 18 years of age or older to subscribe to the NetworkTik service. Our Service does not address anyone under the age of 18 (“Children” or “Minor”). Minors may only use the service with the involvement, supervision, and approval of a parent or legal guardian. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

12. CHANGES TO THIS PRIVACY POLICY

We will update this Privacy Policy from time to time in response to changing legal, regulatory or operational requirements. We will provide notice of any such changes (including when they will take effect) in accordance with law. Your continued use of the NetworkTik service after any such updates take effect will constitute acknowledgement and (as applicable) acceptance of those changes. If you do not wish to acknowledge or accept any updates to this Privacy Policy, you may cancel your use of the NetworkTik service.
